Child Custody Lawyers Hinsdale IL

As child custody lawyers we know that the entire divorce process becomes more difficult and contentious when children are involved. However, a divorce should not divest children of their birthright of getting the support and love of both parents. Deciding how the children will be raised after the marriage has been dissolved is significantly important to address during divorce proceedings, which sometimes lead to disputes between parents. It is essential to get legal counsel from a reliable and experienced child custody attorney who can help you protect your parental rights as well as your relationship with the children.

Dan Walker Law Office has been offering legal services for family law matters for decades and our attorneys have more than 45 years of combined legal experience. Our child custody lawyers have in-depth knowledge of the latest Illinois laws governing child custody issues and know the ins and outs of the entire legal system. We help parents to work out a solution that is fair for all. We strive to settle matters through negotiation, allowing both parties to reach a final decision amicably.

Updated Illinois Child Custody Laws

Illinois child custody laws underwent changes that involved new terminology as well as how child custody determinations are made by family law courts. As of January 1, 2016, legal terms, including custody, custodial parent, and visitation, have been removed and new terminology has been included, such as allocation of parental responsibilities, parenting time, parental plans, and others.

The new guidelines in the Illinois Marriage and Dissolution of Marriage Act (IMDMA) have ended the sole and joint custody clause and introduced co-parenting, where both parents have to take part in raising the child to some extent. The court will assign one or both parents different categories of responsibilities, such as medical, religion, education, and extracurricular activities, based on the needs of their children. All child custody determinations will be included in a comprehensive legal document called the parenting plan.
